These rules ("Supplemental Rules") are in addition to this Sweepstakes' Official Rules (the "Official Rules"). It is strongly recommended that you review these Supplemental Rules and the Official Rules in their entirety before entering the Sweepstakes. To the extent there is any conflict between these Supplement Rules and the Official Rules , the terms of these Supplemental Rules shall govern the Sweepstakes.

WHO CAN ENTER:

This Sweepstakes is only open to legal residents of the fifty (50) United States (except California) and Canada (except Quebec) who are at least eighteen (18) years of age or older (or at least 19 in Alabama, Nebraska, and in the Provinces/Territories of British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, and Yukon) at the time of entry. Employees, officers, and directors of Sponsor, Charity, Prize Provider, and members of their immediate families and households, are not eligible to win. See the Official Rules for more details. By participating, entrants agree to these Supplemental Rules and the Official Rules, and the decisions of the Sponsor, which are final and binding in all matters relating to this Sweepstakes.

HOW TO ENTER AND ENTRY WEIGHTING:

Participants may enter the Sweepstakes by visiting the Sweepstakes Website during the Sweepstakes Entry Period and following the on-screen prompts. If you donate: $10 USD you will receive ten (10) entries; $20 USD you will receive forty (40) entries; $50 USD you will receive one hundred and fifty (150) entries; $87 USD you will receive three hundred (300) entries. Entrants will receive an email confirmation at the email address provided on the Sweepstakes Website. All donations are final and non-refundable. All donations will be in USD. Individuals who do not meet the eligibility criteria as provided herein that donate and receive entries will not be eligible to win the Prize should their entry be drawn.

Each successfully submitted free entry is worth 40 entries in the Sweepstakes (which corresponds to the same number of entries received for a $20 donation).

There is no limit to the number of entries any one person may have.

Odds of Winning: The odds of winning a Prize depend on the total number of eligible entries received during the Sweepstakes Entry Period. There is no limit to the number of entries the Sponsor may receive.

WINNER SELECTION:

On or about October 1st, 2024 after the close of the Sweepstakes Period, Sponsor will randomly select one (1) Grand Prize winner from the entire pool of valid entries received during the Sweepstakes Entry Period ("Valid Entries Pool"). Subject to the conditions and Winner Verification requirements provided in these Supplemental Rules and the Official Rules, the Prize Winner shall be declared the winner of the Prize. The Winner of the Prize will be subject to all rules of eligibility, verification, confirmation and any and all other conditions to which the as described in these Supplemental rules and the Official Rules including, but not limited to, the Prize Conditions, Publicity and Liability Releases described herein.

WINNER VERIFICATION:

Once a potential Winner is selected and successfully notified, Sponsor shall verify potential Winner's eligibility to win the Prize and compliance with the terms and conditions of the Official Rules. The Potential Winner will be required to provide proof of age through government-issued identification to confirm age of majority in Potential Winner's jurisdiction. The Potential Winner will be required to complete and return an Affidavit of Eligibility, Release of Liability and/or Publicity Release (where permitted by law) in the form(s) provided by Sponsor (collectively, the "Affidavit") by the date/time specified by Sponsor, or such Potential Winner will be disqualified and an alternate Potential Winner may be selected. Potential Winner will be declared a Prize Winner when all the conditions of the Official Rules, the Supplemental Rules are fulfilled to the satisfaction of the Sponsor in its sole discretion. See the Official Rules for more details. If a potential Winner cannot be reached (regardless of reason), does not respond within the designated time (if required), or there is a return of any Prize/Prize notification as undeliverable, he/she may be disqualified. See the Official Rules for more details. Upon disqualification, no further compensation will be given. Failure to comply with any term or condition in these Supplement Rules or the Official Rules may result in disqualification at Sponsor's sole discretion. In the event that a Potential Winner is disqualified for any reason, an alternate Potential Winner may be selected from the remaining valid entries in connection with the winner selection method above. Sponsor may limit the number of attempts to award the Prize to two (2) attempts. In such case, if a Winner cannot be confirmed after two (2) attempts, the Prize will remain un-awarded. AN ENTRANT IS NOT A WINNER OF THE PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND COMPLIANCE WITH THESE SUPPLEMENTAL RULES AND THE OFFICIAL RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

PRIZE CONDITIONS: Prize is not transferable. Prize must be claimed as a whole and Prize substitution, in whole or in part, will not be allowed except in Sponsor's sole discretion. See Official Rules for details. Sponsor is not responsible if the Winner does not use any portion of the Prize. All expenses and costs associated with the acceptance or use of the Prize that are not expressly specified in these Supplemental Rules as being part of the Prize are the sole responsibility of the Winner. Sponsor or Prize Provider will not replace any lost or stolen Prize. In the event a Prize is subject to delays, substitutions, discontinuations, and/or availability issues or other restrictions or circumstances beyond Sponsor's and Prize Provider's control as determined by Sponsor in its sole discretion, Winner shall be provided with a Prize of equivalent or greater value in the Sponsor's sole discretion. Prize cannot be redeemed for cash and no cash alternative or prize substitution will be allowed, except in Sponsor's sole discretion and except as provided herein. Sponsor and Prize Provider are not responsible for Prize utility. Sponsor and Prize Provider make no express and/or implied warranties of any nature whatsoever, including, but not limited to, any warranty of merchantability or fitness for a particular purpose

TAXES:

All taxes at the federal, state, or local level in connection with the acceptance of a Prize will be the sole responsibility of the Winner. Winner will be issued a Form 1099 where required.

NHL RULES:

These Supplement Rules and the Official Rules shall in all respects be subject to and subordinate to each of the following, as such may be amended from time to time: (a) the NHL Constitution; (b) the NHL By-laws; (c) all other rules, regulations and policies of the NHL and the resolutions of its Board of Governors; (d) any collective bargaining agreement between the NHL and/or its member clubs and other parties; (e) all consent decrees and settlement agreements entered into, between or among the NHL and its member clubs or the NHL, NHL member clubs and/or other persons in furtherance of NHL business or interests or as otherwise authorized directly or indirectly by the NHL Board of Governors, the NHL Commissioner, or the NHL Constitution; (f) any television or cable, radio, or other media network agreements between the NHL and third parties; and (g) any national corporate marketing, licensing, sponsorship or similar agreements between the NHL (or NHL affiliates) and third parties, all as the same may now exist or hereafter be amended or enacted or as they may be interpreted by the Commissioner.

RELEASE OF LIABILITY:

By participating in the Sweepstakes, each entrant agrees to the full extent allowed by applicable law to: (a) comply with and be bound by the Official Rules, these Supplemental rules, and the decisions of Sponsor, which are binding and final in all matters relating to the Sweepstakes; (b) defend, indemnify, release and hold harmless the Sponsor, the Charity, Prize Provider, CAFA, the Pittsburgh Penguins LP, PPG Industries, Inc., AEG Management Pittsburgh, LLC, ARAMARK Sports and Entertainment Services, LLC, the NHL, and each of their respective parent, subsidiary, and affiliates and affiliated companies, subsidiaries, affiliates, advertising/promotion agencies, and each of their shareholders, celebrities, partners, members and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, franchisees, agents, attorneys and representatives, and their successors and assigns (collectively, the "Released Parties") from and against any and all claims, expenses, and liability, including but not limited to personal injury, death, or damage to or loss of property, negligence and damages of any kind to persons and property, arising out of participation in the Sweepstakes, or receipt or use or misuse of the Prize, and for claims based on publicity rights and intellectual property rights, defamation, including but not limited to invasion of privacy, defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entrant's entry, creation of an entry or submission of an entry, participation in the Sweepstakes, travel, lodging, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of Sweepstakes Prize, or any portion thereof (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) waive any right to claim ambiguity in the Sweepstakes or these Official Rules and/or any supplemental rules. Released Parties are not responsible if the Sweepstakes Prize, or any portion thereof, is delayed, postponed or cancelled for any reason, in which event that portion of the prize is forfeited in its entirety and no substitution will be provided except at the Sponsor's sole discretion. The Sweepstakes Winner acknowledges that all prizes are awarded "as-is" and the Released Parties make no representations or guarantees and expressly disclaim any warranties, express or implied, including, but not limited to, the warranties of merchantability and fitness for a particular purpose, relating to the Sweepstakes Prize in any way.

PUBLICITY RELEASE:

Except where prohibited or restricted by law, a Winner's acceptance of a Prize, or any portion thereof, constitutes the Winner's agreement, permission and consent for Sponsor, the Charity, Prize Provider, any other Released Parties, and any of their designees to use and/or publish the Winner's, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, and/or statements made by the Winner regarding the Sweepstakes or otherwise, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, publicity, trade and/or promotion on behalf of Sponsor or the Charity, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. All trademarks used are the property of their respective owner(s) and are used for prize description purposes only. In order to participate in the Sweepstakes, entrants will be required to supply certain information about themselves on the Sweepstakes entry pages. Sponsor has specified on the Sweepstakes Website which information is mandatory in order to participate in the Sweepstakes. This information will be used by Sponsor for the purposes of administering the Sweepstakes, and may be shared with the Charity where you have consented to do so. The personal information collected in order to administer the Sweepstakes will be processed and used in accordance with Sponsor's Privacy Policy. WINNERS LIST:

For the name (first name and last initial) of the Prize Winner, send a self-addressed, stamped envelope to "Winners List - List - Pittsburgh Penguins Foundation Back to Hockey Sweepstakes 2024", c/o Ascend Fundraising Solutions 700 - 1 Yonge Street, Toronto ON M5E 1E5 or to Winners List - Pittsburgh Penguins Foundation Back to Hockey Sweepstakes 2024 c/o Ascend Fundraising Solutions, P.O. Box 8547, 940 Thayer Ave. Silver Spring, MD 20910-5160. Residents of VT may omit return postage. Winner requests must be received no later than ninety (90) days after Draw Date.

DONATIONS TO THE CHARITY:

100% of all donations made to this sub-campaign go to Charities Aid Foundation America ("CAF America"), which is a globally recognized United States 501(c)(3) public charity (Federal Tax ID # 43-1634280). Upon recommendation by Ascend and after CAF America completes their due diligence and grant approval process, CAF America distributes the donations, minus the expenses involved in operating the sub-campaign, as a grant to the charity identified in this sub-campaign (the "Charity Beneficiary"). Ascend does the legwork on the sub-campaign so the CAF America and the Charity Beneficiary can focus on doing what they do best - furthering their charitable missions.

Each Charity Beneficiary is vetted by CAF America through an eligibility process. As long as the Charity Beneficiary meets CAF America's stringent due diligence criteria, they can be recommended by Ascend to receive a grant from CAF America from the donations of this sub-campaign. If the Charity Beneficiary is no longer eligible (per CAF America's eligibility criteria or policies and/or applicable laws) or if CAF America's Board of Directors reject the grant, then CAF America may (i) withhold distribution of the donations until the Charity Beneficiary is eligible or (ii) reassign the donations to another nonprofit or charity that supports a similar cause. If CAF America reassigns the donations to an alternate organization, the sub-campaign page will be updated to identify what entity(ies) received the grant(s).

Depending on the type of sub-campaign, the Charity Beneficiary may receive anywhere from 15%-80% of the total donations via a grant from CAF America as long as they continue to be eligible to receive a grant. Your donation is broken down as follows:

  • CAF America retains a small percentage of the total donations (between 0.5%-3%) to cover its administrative costs.
  • Ascend takes a fee starting at 15% of total donations to cover its costs of arranging the sub-campaign and providing the technology and expertise behind executing and operating sub-campaigns. The fee will vary depending on Ascend's role in executing the sub-campaign:
    • Where the prizing or marketing costs are donated, Ascend's fee will be lower, and the Charity Beneficiary may accordingly be eligible to receive a larger grant from CAF America.
    • Where Ascend arranges for and pays for the prizing and marketing, Ascend's fee will be higher as those sub-campaigns have higher costs and effort associated with successfully arranging and executing those sub-campaigns.
  • Costs associated with arranging and operating the sub-campaign are payment processing fees, prize costs, and marketing and press relations costs

Ascend sends 100% of donations from this sub-campaign to CAF America within 2 business days of Ascend's receipt of the donation. After the sub-campaign is completed, CAF will usually distribute the donations 2 to 3 weeks after the conclusion of the sub-campaign, subject to their approval process. CAF America retains exclusive control over all donations raised in this sub-campaign.
